Texas has specific regulations on when you can buy fireworks, where you can shoot them, and what types are permitted. Stay legal and avoid fines.
Legal Selling Seasons
Retailers in Texas can only sell fireworks to the public during these specific windows.
County Specific seasons require authorization from the local commissioner’s court.
No-Blast Zones
According to Sec. 2154.251, it is illegal to explode or ignite fireworks within:
600 feet
Of any church, hospital, asylum, licensed child care center, or public/private school.
100 feet
Of a place where flammable liquids (gas stations) or compressed gases are stored.

Legal Age Requirement
16+
You must be at least 16 years old to purchase fireworks in Texas.
Prohibited Items
Small Bottle Rockets
Rockets with a propellant charge of less than 4 grams, casing size less than 5/8″ x 3.5″, and overall length less than 15″ are banned.
Pop Rockets
Rockets with a casing length less than 5″, exterior diameter less than 3/4″, and total length less than 26″.
City vs County
It is Illegal to shoot fireworks within a city’s limits
Most cities in Texas (like Austin, Pflugerville, Georgetown, etc…) ban the use of fireworks within city limits.
Typically in the unincorporated county’s jurisdiction it is legal to enjoy fireworks but, but always check your specific HOA or local ordinances.
State Laws
Firework sales are no longer considered a nuisance
Texas Sec. 217.042 was passed that states that a municipality may not define and prohibit as a nuisance the sale of fireworks.
Confiscation of fireworks are prohibited
Texas Sec. 342.013 was passed that says, a municipality cannot confiscate packaged, unopened fireworks while being transported as long as the fireworks are out of reach of the driver. For example, fireworks must be in
(1) a locked glove compartment or similar locked storage area
(2) the trunk of a vehicle; or
(3) the area behind the last upright seat of a vehicle that does not have a trunk.
